Driveway Approach & Sidewalk Permit

Reconstructed driveway and sidewalk

A Driveway Approach & Sidewalk Permit is required to reconstruct or modify an existing sidewalk or driveway fronting residential or commercial properties within the public right-of-way, or public easements. This permit applies when there is no other development work, land-use actions, or other work in the right of way such as a water or sewer service. (In those other cases, a Public Works Permit will be required per Section 102.1.1 of the Public Works Construction Code.)

DEFINITIONS

Modify - The removal of an impervious surface that exposes gravels, aggregates, or soil followed by the placement of impervious or pervious surfaces.

Right-of-way - A general term denoting land, property, or interest property acquired for or devoted to public use.

In order to fulfill the requirements of the permit application process, the following tasks will need to be completed:

1.   Confirm your Contractor is licensed by the Oregon Construction Contractors Board using the State’s online CCB search tool: Contractor License Search

2.   Complete a Driveway Approach & Sidewalk Permit Application using the City's online Web Portal, eTrakit.

3.   With the Application, include a permit fee as set forth in the City of Tualatin Fee Schedule

4.   You are required to provide financial assurance for performance of the work, in an amount equal to twice the cost of construction as approved by the City Engineer.

  • For example, if the job amount is $4,000 the financial assurance would be $8,000.  This assurance is to ensure that the applicant constructs and completes all required improvements within the public right of way, as described in Tualatin's Public Works Construction Code, Section 102.14.00
  • Financial assurance payment can be made by:
    • Bond by a licensed bonding agency using the City's Bond Template;
    • Cash;
    • Check made payable to The City of Tualatin.

5.   Provide proof of Contractor's Insurance and Indemnification as set forth in Section 102.6.1 of the Public Works Construction Code.
