Utility Facilities in the Rights-of-Way: Rights-of-Way and Attachment Fees

All Utility Providers with facilities in the right of way are required to have a valid right of way license.

Utility Providers must obtain a Franchise Permit before conducting any work in the right of way. 

Utility Providers with facilities in the right of way are subject to the following fees:

Rights-of-Way Fee Section in the Municipal Code

Electric 3.5% of Gross Revenue
Natural Gas 5.0% of Gross Revenue
Communication 5.0% of Gross Revenue
Any Utility Operator that does not earn Gross Revenues within the City of Tualatin (Based on Total Linear Feet of Utility Facilities in the Rights-of-Way):

"Gross Revenue" means any and all revenue, of any kind, nature or form, without deduction for expenses, less net uncollectibles, derived from the operation of utility facilities in the City of Tualatin, subject to all applicable limitations in federal or state law. 

The Rights-of-Way Fees are paid quarterly, within 45 days after the end of the calendar quarter.

Fees for each attachment must be paid if the utility operator only has facilities in the rights of way that are mounted on structures within the rights of way; the structures on which the facilities are mounted are owned by another person; and the utility operator does not have any facilities strung between such structures or otherwise within, under or above the rights-of-way. 

Attachment fees do not authorize an attachment to be located on a structure without the structure owner's consent. 

Attachment Fees are paid annually, no later than January 31st. Fees can be submitted using your own form or using the City's Attachment Fee Submission Form, below.
